1. Agreement
These Terms of Service are entered into with Toasted Mixie Ventures Inc. (“TMV Inc.”, “we”, “us”), a Florida corporation located at 66 W Flagler St, Suite 900, Miami, FL 33130, which operates the Toasted brand and the drinktoasted.com online store. They govern your use of drinktoasted.com and your purchase of Toasted products. By using this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.
2. Eligibility
You must be at least 21 years old to use this site or purchase our products. See our Age Verification Policy. By placing an order you represent that you are 21 or older and that it is lawful for you to receive hemp-derived products at your delivery address.
3. Products and compliance
Toasted beverages are made with hemp-derived cannabinoids and are intended to comply with applicable federal and state law. State law on hemp-derived beverages varies and changes. You are responsible for knowing whether these products are permitted where you live. We reserve the right to refuse or cancel any order for compliance reasons, and to stop shipping to any state at any time.
4. No medical claims
Statements on this site have not been evaluated by the Food and Drug Administration. Toasted is not intended to diagnose, treat, cure, or prevent any disease. Nothing on this site is medical advice. Consult your physician before use if you are pregnant, nursing, taking medication, or managing a health condition.
5. Drug testing and impairment
Toasted contains hemp-derived THC. Consumption may cause impairment and may result in a positive drug test. Do not drive or operate machinery after consuming Toasted. You assume all risk associated with consumption.
6. Orders, pricing, and availability
All orders are subject to acceptance and product availability. We may limit quantities. Prices are shown in US dollars and may change without notice. We work to keep product information accurate, but we do not warrant that all descriptions, images, or pricing are free of error. If a product is listed at an incorrect price, we may cancel the order and refund you.
7. Shipping and risk of loss
Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier. Delivery estimates are not guaranteed.
8. Returns and refunds
Returns and refunds are governed by our Refund and Return Policy.
9. Subscriptions
If you enroll in Subscribe and Save, you authorize us to charge your payment method on a recurring basis at the interval you select, at the then-current subscription price, until you cancel. You may cancel, pause, or reschedule at any time before your next billing date. Cancelling does not affect orders already billed and processed.
10. Accounts
If you create an account, you are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.
11. Intellectual property
The Toasted name, logo, packaging, copy, photography, and site design are our property or used under license, and are protected by trademark and copyright law. You may not use them without our written permission.
12. Acceptable use
You agree not to use this site to violate any law, infringe anyone's rights, interfere with site security or operation, or attempt unauthorized access to any part of the site or its systems. You agree not to purchase our products for resale without a wholesale agreement with us.
13. Third party links and services
This site may link to or integrate third party services. We are not responsible for their content, practices, or availability.
14. Disclaimer of warranties
Except as expressly stated, this site and our products are provided on an as is and as available basis without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
15. Limitation of liability
To the fullest extent permitted by law, Toasted and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
16. Indemnification
You agree to indemnify and hold Toasted harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your misuse of our products.
17. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
18. Changes to these terms
We may update these terms at any time. The updated version takes effect when posted, and the date at the top will reflect the change. Your continued use of the site means you accept the updated terms.
